The persistence of the family finally got a National Crime Victims Org to tell DA Victim Advocate to do her job and get the sheriff report and Autopsy. Before giving it to the family they gave it to the Press Enterprise which published a false statement front page 5 months after Nye Franks death. When the family did a FOIA and got the sheriff audio discovering the information not in the records they reported it. The DA Cheif Deputy Mike Rushton sealed the records he said for ten years for his privacy. The Prosecutor Daima Calhoun threatened to arrest 72 year old Lee Frank if she kept pursuing this case. Both Rushton and Calhoun were promoted immediately. The killer was let out of jail in less than 24 hours. He and his family stalked and isolated Lee Frank from neighbors, Mostly elders. This was not the first elder the killers family is alledged to take advantage of. The property they were at when Nye Frank was killed was one that was given to them by a attorney instead of the family, that attorney now a judge in probate court.Her brother worked in the court house where the killers probation records were removed. When reported to the new internal affairs department he was fired. It is beleived this case was related to his loss of his job. Brian Floyd the Legislative Representative the killers dad says will help to the sheriff and to the prosecutor also blogs on a wrestling site with the attorney Dimaggio son. Dimaggio was a major fund raiser for the prosecutor Daima Calhoun organization for Black Prosecutors. The judge Richard Fields a member of the prosecutors organization and supervising Ty Reddish summary probation denied the family request to go to the hearing. Judge Fields was also a member on a water board with Brian Floyd. In April 2008 the DA was given a award for his Elder Crime Victims Program. That shocked the Frank family as they were told that Riverside County did not have a elder crime victim advocate. They were also denied all federally funded assistance, victim compensation, victim restitution. When the daughter called for a appointment with the victim advocate to get a explanation for the award and the reason for not providing the services to her the advocate Kim Emmerling quit.
